VeggieJournal – Terms of Use

Version 1
Effective Date: 1st June 2026

These Terms of Use explain the agreement between you (“you”, “your”) and Mind’s Eye Design Ltd (“we”, “us”, “our”) in relation to your use of the VeggieJournal web application (“VeggieJournal”, “app”, “App”) and any related services. Our aim is to be as clear and transparent as possible so that you understand what VeggieJournal offers, what we expect from you, and how we protect you and ourselves.

VeggieJournal is a browser-based digital journaling platform designed to help gardeners document their plots, record their progress, keep track of seeds and harvests, and enjoy their growing journey. These Terms set out the rules of use for the VeggieJournal web app at https://veggiejournal.app (“the Website”) and all associated functions (“the Service”).

By accessing or using VeggieJournal, you confirm that you:

  • are 16 years of age or older;
  • have read and understood these Terms;
  • agree to follow and abide by these Terms in full.

If you do not agree, you must not use VeggieJournal.

1. Who We Are

VeggieJournal is operated by:
Mind’s Eye Design Ltd
Company number: 04587959
Registered office: 4 Further Field, Staplehurst, Tonbridge, Kent, TN12 0SX

Contact: support@veggiejournal.app

For clarity, VeggieJournal is not a downloadable app from the Apple App Store, Google Play Store, or similar platforms. It is accessed exclusively through standard internet browsers such as Chrome, Safari, Firefox, and Edge.

Explanatory note: We want users to understand clearly that VeggieJournal runs entirely online, which requires internet access, so there is no software to install and no automatic device-level permissions.

2. Changes to These Terms

We may update or amend these Terms from time to time, for example, to reflect new features, legal requirements, or improvements. When we do, the “Effective Date” above will change. If the update is significant, we will try to notify you through the Website or by email.

Continuing to use VeggieJournal after an update means you accept the revised Terms.

We may add, remove, or modify features, functions, or content within VeggieJournal at any time. Where possible, we will provide notice of significant changes, but we are not obliged to maintain any specific feature or section of the Service.

2.1 Electronic communications

We will normally communicate with you by email or by displaying messages within VeggieJournal. You agree that electronic communications from us (including emails, in-app notices and messages on the Website) satisfy any legal requirement for such communications to be in writing.

Explanatory note: This section ensures that VeggieJournal can grow and evolve without requiring new user agreements for updates, changes, and improvements.

3. Creating and Using Your Account

3.1 Registering

Some features of VeggieJournal are available without an account via the Website, but most require registration for the App. You may choose from our account tiers (Free, Seedling, Harvest, Abundance, or any future levels we may add).

You must provide accurate and truthful information, and keep this up to date.

3.2 Minimum Age

The Service is strictly for users aged 16 or over. You must not allow children under 16 to use your account or access VeggieJournal.

3.3 Account Security

You are responsible for safeguarding your login details. Please keep them confidential and never share them with others. If you suspect unauthorised access, you should change your password immediately and notify us.

3.4 Browser Access Only

VeggieJournal runs entirely in your internet browser. You are responsible for your own device, internet connection, and browser configuration.

Your use of VeggieJournal requires a compatible device, supported browser, internet connection, and JavaScript enabled. We are not responsible for issues caused by unsupported devices, outdated browsers, or connectivity problems.

3.5 Usernames

We may remove or restrict any username that is inappropriate, misleading, impersonates another person, or violates these Terms.

3.6 No property right in your account

Your VeggieJournal account is a means of accessing the Service and does not give you any ownership or proprietary right in the account itself. We may, where permitted under these Terms, suspend, restrict or close accounts.

4. Your Right to Use VeggieJournal

We grant you a personal, non-exclusive, revocable, non-transferable licence to use VeggieJournal for your own personal journaling and gardening records.

You must not:

  • copy, modify, or reverse-engineer any part of the Service;
  • resell or sublicense your access;
  • use automated scraping tools or bots to extract data;
  • interfere with the proper operation of the Service;
  • bypass or attempt to bypass technical restrictions.

Explanatory note: These restrictions protect the stability of the Service and prevent misuse.

5. Your Content

VeggieJournal allows you to upload images, text, notes, photographs, plans, and other material (“Your Content”).

5.1 You Own Your Content

You retain full ownership of Your Content.

5.2 Licence for Operation

To operate the Service, we require permission to store, process, and display Your Content within your account. This permission is limited solely to operating and improving the functionality of VeggieJournal.

We do not claim ownership of Your Content.

5.3 Prohibited Content

You must not upload anything that:

  • is illegal under UK law or the law in your country;
  • depicts or exploits minors, including any sexualised or harmful content;
  • is hateful, abusive, harassing, extremist, or discriminatory;
  • defames an individual or organisation;
  • infringes another person’s copyright or rights;
  • contains viruses, malware, or harmful code;
  • violates privacy rights or breaches confidentiality.

5.4 Responsibility for Your Content

You are responsible for Your Content. We do not review all content, but may remove anything that breaches these Terms or could expose us to harm or legal risk.

5.5 Indemnity for User Misconduct

You agree to reimburse us for any reasonable costs, losses or expenses we incur as a result of your breach of these Terms, including unlawful content you upload. This does not affect your statutory rights.

5.6 Data Storage Limits / Capacity Limits

We may apply reasonable storage or usage limits to ensure the smooth operation of the Service. We will notify you if any limits apply to your plan.

5.7 Backup & Export Responsibility

We take reasonable steps to maintain the availability of Your Content, but we do not guarantee that data will never be lost. You are responsible for keeping your own backups of Your Content where needed.

5.8 Future Sharing or Publishing Features

VeggieJournal is currently a private journaling platform. All entries, notes, images, files and other content within your account (“Your Content”) are private by default and are only visible to you unless you choose to export them.

In future, we may introduce optional features that allow you to share, publish, export or otherwise make Your Content visible to others (“Sharing Features”). Examples may include:

  • creating a shareable link to a journal entry;
  • generating a view-only page for a seed list or harvest summary;
  • publishing content publicly on the internet;
  • allowing others to view certain entries or sections of your journal.

If and when such features become available:

1. Your Choice to Share

Any Sharing Features will always be optional. You decide what, if anything, you make visible to others. Nothing will ever be shared publicly without your deliberate action.

2. Terms Continue to Apply

All rules in these Terms — including prohibited content, acceptable use, copyright, and user responsibility — apply fully to any material you share or publish.

3. Your Responsibility for Shared Content

You are solely responsible for any content you choose to share or publish. Once shared publicly, that content may be copied, downloaded, linked to, or reused by others. We are not responsible for what others do with Your Content once you make it public.

4. Licence to Display Publicly Shared Content

Where you choose to publish Your Content publicly, you grant us permission to host, display and transmit that content to the public for the purpose of providing the Sharing Features. This does not affect your ownership of Your Content.

5. Moderation and Removal of Public Content

We may remove or restrict shared or published content if:

  • it breaches these Terms;
  • it is illegal, harmful or infringing;
  • it exposes us to risk; or
  • we are required to do so by law.

We may also disable Sharing Features associated with specific content.

6. No Obligation to Store Public Content

We may place reasonable limits on bandwidth, storage, visibility duration or availability of any publicly shared material.

7. No Duty to Monitor

We do not actively monitor all shared content, but we reserve the right to review, restrict or remove it in line with these Terms.

8. Withdrawal of Sharing Features

We may modify or discontinue Sharing Features at any time. If a shared link or published page is removed or withdrawn, we are not liable for any resulting loss or inconvenience.

5.9 Monitoring and investigations

We are not obliged to monitor all activity or content on VeggieJournal. However, we may review content or account activity where we have reason to believe these Terms may have been breached. We may remove content, restrict features, suspend accounts, or report matters to law enforcement or other authorities where we consider it appropriate.

6. AI-Generated Content, Advice and Beta Features

VeggieJournal may, at times, provide suggestions, tips, descriptions, or gardening information generated by automated systems, including AI-powered components.

6.1 Not Professional Advice

All information is provided for general informational purposes only. It:

  • is not tailored to your personal situation;
  • may be incomplete, outdated, or inaccurate;
  • is not a substitute for professional horticultural, medical, financial, or legal advice.

6.2 Your Responsibility

Please use your judgment and verify any guidance before acting on it. Gardening conditions vary widely, and automated systems cannot understand your specific environment.

6.3 AI-Generated Text and Imagery

Some content, including illustrations and images, may be AI-generated. These may be stylised or contain inaccuracies. They should not be relied upon for factual precision.

6.4 No Training on Your Data

Your Content is not used to train any internal AI models.
Marketing communications will only be sent if you have opted in.

6.5 Beta Features

From time to time, we may offer experimental or “beta” features. These are provided on an exploratory basis and may change, break, or be removed at any time. We are not liable for any issues arising from the use of beta features.

7. Third-Party Services

VeggieJournal may link to external websites or tools for convenience. These third parties have their own terms and privacy practices, which we do not control. You use them at your own risk.

7.1 Third-Party Platforms, Hosting and Infrastructure

VeggieJournal is built upon and operated through third-party platforms, hosting providers, software tools, infrastructure services, and other cloud-based or AI-powered technologies (“Third-Party Providers”). These services are not owned, controlled, or operated by Mind’s Eye Design Ltd.

You acknowledge and agree that:

1. Dependence on Third Parties

The functioning, availability, performance, features, and security of VeggieJournal may depend on services provided by Third-Party Providers. We do not guarantee, and are not responsible for, the continued availability, performance, functionality, or security of those third-party systems.

2. No Liability for Failures of Third-Party Providers

We are not liable for any interruptions, delays, data loss, service degradation, or other issues arising from the acts, omissions, changes, failures, or downtime of any Third-Party Provider. This includes (but is not limited to) hosting failures, platform outages, AI errors, withdrawal of features, bugs, or any changes made by other underlying services.

3. Third-Party Terms and Privacy Policies

Your use of VeggieJournal may involve interaction with or reliance upon Third-Party Provider systems that have their own terms of service and privacy practices. Mind’s Eye Design Ltd is not responsible for those policies or practices. By using VeggieJournal, you agree that you may be required to accept and comply with such third-party terms.

4. Changes to Third-Party Technology

Third-Party Providers may modify, update, discontinue, or remove functionality at any time. We may not receive advance notice of such changes. We are not responsible for the impact of such changes on your use of VeggieJournal.

5. Data Processing by Third Parties

While we take reasonable steps to select reputable suppliers, we do not control the internal systems, data storage practices, or compliance measures of Third-Party Providers. Any personal data processed by those providers will be handled according to their respective privacy policies and technical capabilities.

8. Subscriptions, Payments, and Refunds

8.1 Stripe Payments

All subscription payments are handled through Stripe, a secure external payment processor. VeggieJournal does not store or process your card details.

8.2 Subscription Levels

Paid plans unlock additional features. Pricing is shown on the Website and within the App and may change periodically.

8.3 Free Plan

A free plan is available so that users can evaluate VeggieJournal without financial commitment.

8.4 Automatic Renewal

Paid subscriptions renew automatically unless cancelled before the renewal date via your account settings.

8.5 Refund Policy

Because a free tier exists and you may cancel at any time, subscription fees are non-refundable, except where legally required.

8.6 Taxes

Prices may include or exclude VAT depending on your location and applicable tax rules.

8.7 Statutory Rights and Cooling-Off Period

If you are a consumer in the UK, you normally have a legal right to cancel a digital subscription within 14 days of purchasing it. By subscribing to a paid VeggieJournal plan, you agree that the digital service begins immediately, and that full access is provided straight away. As a result, you acknowledge that you lose your statutory right to cancel once the service has started.

This does not affect your other legal rights under UK consumer law.

9. Acceptable Use Policy

To keep VeggieJournal safe and enjoyable for all users, you must use the Service responsibly. You may not use VeggieJournal for any activity that is illegal, harmful, abusive, or disruptive. This includes, but is not limited to:

9.4 Technical Misuse

  • attempts to breach, probe, or circumvent security systems;
  • actions that interfere with or overload the Service;
  • scraping data without express permission.

9.5 Commercial Exploitation

VeggieJournal is intended for personal use. You may not use it to advertise, market products or services, or resell access.

We may monitor, restrict, or remove content, suspend accounts, or report illegal activity to relevant authorities.

10. Data Protection

VeggieJournal complies with the UK GDPR and the Data Protection Act 2018. A separate Privacy Policy will explain how we collect, use, and protect your personal data.

International data transfers

VeggieJournal is operated from the UK, but our service providers may store or process your data on servers located outside the UK (and, where relevant, outside the European Economic Area). Where this happens, we will take steps required by UK data protection law to ensure that appropriate safeguards are in place to protect your personal data. Further details will be set out in our Privacy Policy.

11. Suspension and Termination

We may suspend or terminate your access if:

  • you breach these Terms;
  • you upload illegal or harmful content;
  • your actions pose a risk to the Service;
  • required by law;
  • the Service is discontinued (with reasonable notice where possible).

You may delete your account at any time. We encourage you to export or back up Your Content before doing so.

12. Liability

12.1 “As Is”, “As Available” Basis

VeggieJournal is provided “as is” and “as available”, without warranties of accuracy, availability, or uninterrupted operation.

12.2 No Guarantees

We cannot guarantee:

  • the accuracy or completeness of AI or user-generated information;
  • that the Service will always function without issues;
  • that Your Content will never be lost;
  • particular gardening results, yields, or outcomes.

12.3 Limitation of Liability

To the fullest extent permitted by law, our total liability to you for any claim is limited to: £24 (twenty-four pounds) or the amount you paid in subscription fees during the previous 12 months,
whichever is lower.

12.4 No Responsibility For

  • loss of profits, business, reputation, data, crops, or opportunities;
  • reliance on gardening information or AI-generated content;
  • actions of third-party websites or processors;
  • harm caused by content uploaded by users;
  • indirect or consequential losses.

12.5 User Responsibility

VeggieJournal is a journaling tool, not a professional advisory platform. You use it entirely at your own risk.

12.6 Force Majeure

1. No Liability for Events Beyond Our Control

We will not be liable for any failure to perform, or delay in performing, any obligation under these Terms where the failure or delay results from any event, circumstance, or cause beyond our reasonable control (“Force Majeure Event”).

2. Examples of Force Majeure Events

Force Majeure Events include, but are not limited to:

  • acts of God, natural disasters, storms, floods, fires, droughts or earthquakes;
  • epidemics, pandemics, or public health emergencies;
  • war, threat of war, armed conflict, terrorism, civil commotion or riots;
  • acts or restrictions of any government, public authority or regulatory body;
  • failures, delays or interruptions of utilities or telecommunications networks, including internet outages, DNS failures, or data-centre outages;

  • strikes, labour disputes, industrial action (whether involving our staff or third-party service providers);
  • failure of suppliers, subcontractors, hosting providers, or third-party infrastructure.

3. Suspension of Obligations

Where a Force Majeure Event occurs, our obligations under these Terms shall be suspended for the duration of the event. We may temporarily suspend or limit access to the Service without liability.

4. Reasonable Efforts

We will take reasonable steps to minimise the impact of the Force Majeure Event and restore normal operation of the Service as soon as reasonably practicable. However, we are not required to obtain alternative supply or services where this would involve materially increased cost or unreasonable difficulty.

5. Extended Force Majeure

If a Force Majeure Event continues for longer than 60 days, we may terminate or modify any affected part of the Service without liability to you.

We are not required to use an alternative dispute resolution (ADR) provider to resolve disputes and do not participate in ADR procedures. However, as required by law, we provide the following link to an approved ADR body:

https://www.tradingstandards.uk/consumers/adr-approved-bodies

You are not prevented from seeking a resolution through the courts.
